Chapter 25 - The Motion to Dismiss

The interior of Courtroom 302 was a grand, intimidating expanse of dark mahogany and polished brass. Maya and Ryan sat rigidly in the gallery directly behind the plaintiff’s table, watching as Marcus calmly unpacked his legal pads. Across the aisle sat the defense team, led by Arthur Sterling, a notoriously expensive corporate bulldog hired by the Whitmore estate. Sterling looked excessively confident, wearing a bespoke suit that cost more than most people made in a year.

Judge Hawthorne, a stern woman with zero tolerance for legal theatrics, took the bench and immediately called the court to order. "Mr. Sterling," she said, adjusting her glasses. "I have reviewed your emergency motion to dismiss this case on the grounds of a pre-existing non-disclosure agreement signed by the plaintiff. You have the floor."

Sterling stood, buttoning his jacket with a smug smile. "Your Honor, this entire trial is a gross violation of a legally binding contract. The plaintiff, Clara, signed a comprehensive NDA upon the termination of her employment with Whitmore Holdings. This lawsuit is nothing more than a blatant attempt at character assassination and a targeted shakedown of a respected philanthropic family. The law is clear. The contract bars these proceedings entirely."

Marcus Reed stood up slowly, not bothering to button his jacket. He didn't look at Sterling; he looked directly at the judge. "Your Honor, an NDA is a legal shield designed to protect trade secrets and corporate strategy. It is not, however, a license to conceal systemic abuse, coercion, and criminal intimidation. As outlined in our brief, we have substantial evidence that Clara's signature was obtained under severe duress, specifically the threat of absolute financial ruin orchestrated by Eleanor Whitmore herself. Contracts born of extortion are inherently void."

Sterling’s face flushed. "Objection! That is a baseless, defamatory allegation!"

"It is the entire foundation of our case, Your Honor," Marcus countered smoothly, his voice dropping to a lethal, confident register. "And we have the digital communications to prove it. If the defense is terrified of what discovery will reveal, that is their problem, not the court's."

Judge Hawthorne looked between the two attorneys, her expression hardening. She slammed her gavel down. "Motion to dismiss denied. We will proceed to jury selection. I want to see this evidence, Mr. Reed. Do not waste my time." Marcus sat down, offering Maya a brief, triumphant glance. The first wall had been breached.
