Chapter 24 - The Judge's Advice

I brought Clara’s case file directly to the large conference room where my father often spent his afternoons volunteering. He sat at the head of the long oak table, carefully reading through a stack of legal precedents with his reading glasses perched on the edge of his nose.
“Dad, I need your eyes on this,” I said, sliding Clara’s file across the polished wood.
My father adjusted his glasses and spent the next twenty minutes reading Clara’s tragic story in complete, focused silence. I watched the sharp, analytical mind of Judge Thomas Ellery activate. The older man disappeared, replaced by the formidable legal scholar who had commanded courtrooms for decades.
“They are relying on a false affidavit regarding the separation,” my father finally said, tapping his pen against the paper. “And they filed the injunction in probate court using a loophole in the state’s inheritance statutes.”
“Can we block it?” I asked, leaning forward.
“We can completely dismantle it,” my father replied, a dangerous spark lighting up his dark eyes. “They made a fatal jurisdictional error. Because the life insurance policy was established with a federal employer, the state probate court has absolutely no authority to freeze those specific assets without a federal mandate.”
He looked up at me, a proud smile forming on his lips.
“You need to have Elise file a motion to dismiss for lack of subject-matter jurisdiction,” he instructed clearly. “And then, you file a counter-suit for intentional infliction of emotional distress and bad-faith litigation.”
“They are trying to bully a pregnant widow with expensive legal paper,” I said, feeling my anger rise.

“And they are about to learn what happens when that widow has a former superior court judge drafting her counter-motions in the shadows,” my father chuckled darkly. “Let’s show these cowards exactly what the Langham Fund is capable of.”
I left the conference room feeling a profound sense of gratitude. For so many years, his sharp legal mind had been a wall between us. Now, it was the greatest weapon we possessed to protect the vulnerable.
