Chapter 12 - The Ambush in Arbitration

|

Forty-eight hours after I seized control of the trust, Evelyn launched her retaliation.

Instead of waiting for the formal family court date, her legal team invoked an obscure mandatory arbitration clause within the family trust charter. They filed an emergency injunction to strip me of my trustee authority, claiming I was unfit to manage funds due to psychological instability.

The arbitration took place in a high-security conference room downtown. A retired superior court judge named Judge Thomas presided over the hearing.

Evelyn sat across from me, looking triumphant.

"Your Honor," Attorney Vance began, opening a thick manila folder. "We intend to demonstrate that Sarah Sterling suffers from severe, unmanaged emotional distress stemming from years of psychiatric treatment and postpartum trauma. She is fundamentally incapable of making sound financial or personal decisions."

I frowned, looking at David. "What is he talking about?"

"Your Honor," Vance continued, pulling out a set of stamped medical records. "We present these confidential therapy notes from the Bellevue Wellness Clinic, spanning five years. They clearly show a pattern of deep psychological instability."

My heart stopped beating.

Those were my private therapy records—notes from the grief counseling sessions I attended after our third failed IVF cycle years ago. Sessions where I wept about my feelings of inadequacy, my despair, and my fears of failing as a woman.

"Where did you get those?" I gasped, standing up involuntarily. "Those are protected medical documents!"

"They were submitted anonymously to our offices, Your Honor," Vance lied smoothly, without a hint of shame. "And they clearly state that Ms. Sterling experienced severe depressive episodes and paranoid ideation regarding her family."

Evelyn leaned forward, a sickly sweet smile playing on her lips. "We only want what is best for you, Sarah. You're sick. You need help, not the burden of a multi-million-dollar estate."

Judge Thomas reviewed the pages, his brow furrowing deeply. "These records are extremely detailed, Ms. Sterling. If these evaluations are accurate, they raise serious questions about your current capacity."

David stood up angrily. "Your Honor, these documents were stolen! This is a blatant violation of HIPAA laws!"

"Irrelevant in an emergency trust capacity hearing if public safety or financial squandering is at risk," Vance shot back.

I sat back down, my hands trembling under the table. They hadn't just attacked my legal standing—they had dragged my deepest, most painful grief into the dirt to use as a weapon against me.
