Chapter 5 - Jorge Mendoza's Reckoning

Jorge Mendoza's own legal exposure expanded considerably once Emilio's cooperation and the forensic financial review established his direct involvement in orchestrating the fraud scheme, though his own attorneys mounted a considerably more sophisticated defense than either Karina or Emilio had managed, given the substantially greater resources his development empire could commit to the legal battle.
"He's going to argue plausible deniability," Diane — no, I corrected myself, still occasionally confusing the details of other families' similar reckonings I'd read about secondhand, simply my own attorney, Marisela Contreras, a sharp specialist in complex fraud cases whom Detective Fuentes had recommended once the case's scope expanded beyond simple elder abuse — explained during one of our strategy sessions. "That he provided general business consultation to Emilio and Karina without specific knowledge of the medication withholding or the forged documents. We need to establish, clearly and conclusively, that he knew and directed the specific criminal conduct, not simply that he benefited from its eventual outcome."
The text messages Detective Fuentes's team had recovered from Karina's phone, combined with Emilio's detailed testimony describing specific conversations where Jorge had explicitly discussed "accelerating Elena's decline" and the incompetence filing strategy, ultimately proved sufficient to establish considerably more than passive benefit — clear, active direction of a scheme that had, by any reasonable legal standard, constituted conspiracy to commit both fraud and elder abuse.
"There's something else you should know," Marisela told me, during a briefing roughly four months into the expanding investigation. "The financial forensics team traced Jorge's personal accounts alongside the company's, and found a pattern of payments to a private security firm that specialized, according to public records, in what they euphemistically describe as 'complex business facilitation services.' The timing of several payments aligns suspiciously closely with periods of heightened tension in your father's original 1970s dispute with Hector Mendoza."
"You're saying there might be direct evidence connecting this firm to my father's death," I said slowly.
"I'm saying there's a pattern worth investigating considerably more thoroughly," Marisela said carefully. "I don't want to promise you certainty we don't yet possess. But Detective Fuentes's cold case review has requested the security firm's own records, and depending on what surfaces, we may finally have grounds for considerably more than circumstantial suspicion about what actually happened to your father twenty-two years ago."
That investigation, running parallel to the more immediate fraud case against Karina, Emilio, and Jorge, would ultimately take nearly a year to reach any definitive conclusion, though the eventual forensic accounting review of the security firm's decades-old records did surface a single, damning invoice from the period immediately preceding my father's death — a payment authorized by Hector Mendoza personally, for services described only as "resolution of the Coyoacán complication," dated eleven days before my father's sudden cardiac event.

It wasn't, Detective Fuentes cautioned me, definitive proof of murder in a legal sense sufficient to support new criminal charges against a company whose original architect, Hector Mendoza, had died himself nearly fifteen years earlier. But it was, for my mother and me both, something we had waited twenty-two years to finally possess: confirmation, however incomplete, that my father's death had not been the simple, tragic accident we'd been told to accept, but rather one more casualty of a family's decades-long, ruthless pursuit of land they believed, with a entitled certainty spanning three generations, belonged to them by right rather than by law.
