Over the next seventy-two hours, Claire and her paralegals transformed our hotel room into a command center.
We secured a formal emergency injunction from a Milwaukee county judge, freezing all remaining assets tied to Brandon’s primary accounts, including the secondary business checking accounts he had set up under his personal name.
When Brandon realized his accounts were completely locked down and that a formal police investigation had been launched into the assault on my mother, his tone shifted from arrogant defiance to outright panic.
He couldn't call my phone directly, so he began spamming my email address.
Email Subject: Elena please answer me
Elena, I was stressed out of my mind that night! The market has been crashing, my work has been pressing me, and I lost my temper. I'm sorry about your mom! I'll apologize to her face-to-face! Just lift the freeze on the account so I can pay the truck note!
When I didn't reply to that, another email arrived four hours later.
Email Subject: You are being ridiculous
Your mother provoked me, Elena! She was interfering in our marriage from the day she moved in! And as for the savings account—that was OUR money! I had every right to use OUR capital to help my own flesh and blood get on their feet! You are acting like I committed a crime!
Claire read the email over my shoulder and let out a cold, sharp laugh.
"Print that out immediately and add it to Exhibit C," Claire told her paralegal.
"Why?" I asked.
"Because the idiot just admitted in writing that he took the funds, that he knew you didn't consent to it, and that he used joint marital assets to fund third-party accounts without your authorization," Claire explained, her eyes shining with legal triumph. "He just handed us our entire motion for fraudulent asset dissipation on a silver platter."
Under Wisconsin marital property law, while spouses share joint accounts, transferring large sums of marital capital to third parties without the other spouse's consent to intentionally deplete the estate is considered illegal dissipation of marital assets.
Brandon thought he was just being a good brother and a dominant husband.
